NZ Board of Professional Skin Therapies Follow Up Bulletin to Covid Framework

Dear Valued Professionals,

Thank you everyone for your questions and conversations surrounding the vaccine mandate.

We are doing our best to get the correct information from government of the facts so you can make an informed decision on how to operate under the Traffic Light scheme. NZBPST has written to the Government on your behalf We have written to Minister’s Little & Hipkins and my local MP Simeon Brown (National) seeking clarification on the legislation supporting the need to require vaccination certificates for your staff and clients. Sent: Friday, 12 November 2021 10:27 AM To: C Hipkins (MIN) <c.hipkins@ministers.govt.nz>; A Little Office (MIN) <a.little@ministers.govt.nz>; Simeon Brown <Simeon.Brown@parliament.govt.nz> Subject: Empowering legislation or orders for the Covid Response Framework (CFR)

Dear Sirs,

I am attempting to locate the empowering legislation or orders for the Covid Response Framework (CFR). COVID-19: Epidemic notice and Orders | Ministry of Health NZ makes no apparent mention of this, neither does Order 12. Guidance documents on The COVID-19 Protection Framework | Unite against COVID-19 (covid19.govt.nz) states " a range of sectors may legally choose to implement a vaccination entry requirement for customers".

I wish to understand what protection is offered by legislation in this regard so that I can develop communication resources for a close contact industry sector.

Simeon Brown has responded noting that the empowering legislation has not yet been put before Parliament and “The current scope of the existing legislation isn’t wide enough”. It is possible that mobile services will be permitted.

It seems unlikely that it will be permissible to operate separate areas within a building for vaccinated vs non-vaccinated clients under the traffic light scheme.

The Covid Help desk has informed me (15 November) that the MoH are still drawing up guidelines and will release them over the next two weeks.

We will keep lobbying on your behalf for better information.

Clarification on the Traffic Light pictogram Under the traffic light framework, in the red and green stages, the 1 metre distance refers to distancing between clients or between clients and staff in “public” areas. Of course, when you are with your client you can be as close as necessary so long as you are wearing your mask. For any further assistance please email (admin@nzbpst.co.nz) or phone the NZBPST for advice.
